The terms and conditions as set out herein (“Terms”) govern the usage of the Ruqyaah service and the Platform (defined herein below) and constitute a legally binding agreement between Ruqyaah.com, which operates the Platform (“Ruqyaah.com”, “we”, “us” or “our”) and the user of the Platform (“you” or “your” as the context may permit). The effective date of the Terms is 29th July, 2024.

For the purposes of these Terms “Platform” means www.Ruqyaah.com

1. GENERAL

1. Ruqyaah.com provides astrological content, reports, data, telephone, email and direct consultations’ content via the World Wide Web, electronic mail, mobile telephone, telephone, SMS and mobile/ tablet applications. Although portions of the Content may be viewed simply by visiting Ruqyaah.com (the General Services), in order to access the personalized Rehbar zone and/or receive additional Content and services (including telephone-based services) from Ruqyaah.com (the Personalized Services), you shall need to register as a member of Ruqyaah.com (collectively the “Services”).

2. Your continued access and use of the Platform represents that the information (including mobile number) provided by you at the time of registration on the Platform is accurate and up to date in all regards. In case of any change in your personal information post your registration as a user of the Platform, you hereby undertake to update the same within a reasonable time. For details relating to collection of your information, please read our privacy policy.

3. We are continuously working to improve your experience with the Platform and to this end we may from time to time change the Terms that govern your use of the same, without any prior notice. You are requested to familiarise yourself periodically with the Terms.

4. Any accessing, browsing, or otherwise using of the Platform indicates your agreement to the Terms, our privacy policy and any other policies or guidelines as may be applicable (collectively, the “Agreement”). If you disagree with any part of the Terms, then you should discontinue access or use of the Platform. Please read the Terms carefully before proceeding.

2. THE GENERAL SERVICES AND THE PERSONALIZED SERVICES

The General Services and the Personalized Services have been referred collectively as ‘Services’ in these Terms of Service. When you avail any of the Personalized Services, you agree to:

1. Provide the requisite amount of current, relevant, complete, and accurate information about yourself, as and when prompted to do so by the Platform;

2. Maintain and update this information, as and when required, to keep it accurate.

3. Please note that all information that We request and You provide on original sign-up, and all updates thereto, are referred to in these Terms of Service as Registration Data.

3. MEMBER ELIGIBILITY

The Services are available only to individuals who can form legally binding contracts under the applicable law. Without limiting the foregoing, the Services are not permitted to be used by minors (which means, in most jurisdictions, those under the age of 18 years) or temporarily or indefinitely suspended Ruqyaah.com members.

4. MEMBER REGISTRATION DATA

Upon registration, including your provision of Registration Data, you will receive a unique Ruqyaah.com identification (ID) and a password. You shall be entirely responsible for maintaining the confidentiality of your Ruqyaah.com ID and password. You shall be responsible for all uses of your account, whether or not actually or expressly authorized by you. You may change your password by following instructions on the Platform. You agree that your account, ID, and password may not be transferred or sold to another party. You also agree to immediately notify Ruqyaah.com of any unauthorized use of your account or any other breach of security known to you.

5. OUR ACCESS TO YOUR ACCOUNT

In order to ensure that Ruqyaah.com is able to provide high quality services, respond to customer needs, and comply with laws, you shall hereby consent to Ruqyaah.com employees and agents being able to access your account and records on a case-by-case basis to investigate complaints or other allegations or suspected abuse.

6. MODIFICATION TO SERVICES; BREACH; TERMINATION

Ruqyaah.com may modify or discontinue (in whole or in part/s) any of its Services or your membership account, with or without notice, for any reason without any liability to you, any other user, or any third party. Without limiting the foregoing, we also reserve the right to terminate your account immediately (a) if We are unable to verify or authenticate Your Registration Data or other information provided by you, (b) if We believe that your actions may cause legal liability for Ruqyaah.com, or all or some of our other users, or (c) if We believe you have – provided us with false or misleading Registration Data or other information, have interfered with other users or the administration of the Services, or have violated these the Agreement.

7. MEMBER BEHAVIOR AND RESTRICTIONS

a. Compliance With Laws: Your right to use our Services is personal to you. You represent that you are an individual, and that You are not a corporation or other business entity. You agree not to resell or make any commercial use of the Services. You are also solely responsible for the content of your transmissions through our Platform. Your use of the Services is subject to all applicable local, state, national and international laws and regulations. You agree:

i. To comply with all Indian laws regarding the transmission of technical data through our Services;

ii. Not to use the Platform or any of our Services for illegal purposes;

iii. Not to interfere or disrupt networks connected to Ruqyaah.com;

iv. To comply with all applicable regulations, policies and procedures of networks connected to the Platform; and

v. To comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of the Services.

b. The Platform makes use of the Internet to send and receive certain messages. Therefore, your conduct is subject to Internet regulations, policies, and procedures. You will not use the Platform for chain letters, junk mail, spamming, or any use of distribution lists to any person who has not given specific permission to be included in such a process. You agree not to transmit through the Platform any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material of any kind or nature. You further agree not to transmit any material that encourages conduct that could constitute a criminal offence, give rise to civil liability, or otherwise violate any applicable local, state, national or international law or regulation. Attempts to gain unauthorized access to other computer systems/ servers are strictly prohibited. You shall not interfere with any other Ruqyaah.com members’ use or enjoyment of the Platform and/or Services.

c. You agree that notwithstanding your telephone/mobile being registered with NDNC and or notwithstanding the Telecom Regulatory Authority of India [TRAI] restrictions/ guidelines on unsolicited telecalls, by virtue of you choosing to avail services from the Platform, and/or accessing the Platform and/or leaving the Platform half way enquiring/ to verify the Services and/or your making a request to call back, it is deemed that you have expressly authorized us and are hereby authorizing us to call you back or send you text messages for solicitation and procurement of our services. In this regard you shall not i) have any complaint; or ii) complain to TRAI, as to any alleged unsolicited calls from us.

8. NO WARRANTY

a. You agree that Rehbar calculations are based on scientific equations and not on any specific published almanac. Although broadly based on Islamic hadith, the reports generated and the predictive texts must be considered purely as an opinion based on the principles of Rehbar. Under no circumstances shall we entertain any dispute on differences arising out of any comparisons between the reports shared through the Platform and other astrology service sources and/or inaccurate outcomes. You further understand that the Ruqyaah services and the predictive texts in the Services are subject to continuous modifications, including addition of new chapters, and that this is necessitated by the nature of content and constantly evolving research findings, and that there are minor variations in the systems and practices followed in different regions of India and we have accommodated some of these variations in the regional language versions and that as such, the reports generated by the services in different languages may not be exact translations.

b. You ought to understand and agree that all the Services by Ruqyaah.com are provided on your demand. Besides, Ruqyaah.com assumes no responsibility for availability (or lack thereof), deletions or failures to store any member communications or personalization settings. In particular, but not by way of limitation, Ruqyaah.com may delete e-mail or other accounts or the information therein if the account is inactive for more than ninety (90) days. The use, application and understanding of all the predictions and explanations, forming part of the Services, is on the User’s discretion, and the User shall be solely responsible for any eventuality, if any arises. Ruqyaah.com, on behalf of itself and its subsidiaries, disclaims all warranties of any kind, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, title, or non-infringement and it makes no warranty or representation regarding the results that may be obtained from the use of the Platform, the accuracy or reliability of any content obtained through the services, any goods or services purchased or obtained through Ruqyaah.com, or any transactions entered into through Platform, and makes no warranty that the services will, at all times, meet your exact requirements, be 100% uninterrupted, 100% timely, secure or error free. No advice or information, whether oral or written, obtained by you from Ruqyaah.com or through the services shall create any such warranty.

c. The reports are based on the data provided by you and the best possible research support we have received so far. We do not assume any responsibility for the accuracy or the effect of any decision that may be taken on the basis of the reports availed by you through the Platform.

9. LIMITATION OF LIABILITY

In no event will Ruqyaah.com or its subsidiaries, affiliates, directors, agents, representatives be liable for any indirect, incidental, special, consequential or punitive damages of any kind, including but not limited to damages for loss of profits and the cost of procurement of substitute goods and services (collectively, indirect damages) arising out of or in connection with the Platform and/or the Services (however arising, including negligence), even if Ruqyaah.com had been advised of the possibility of such damages. Without limiting the foregoing, Ruqyaah.com will not be liable for indirect damages arising out of or in connection with THE USE OF OR THE INABILITY TO USE THE SERVICES, ANY SERVICES PURCHASED OR OBTAINED THROUGH THE PLATFORM, OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH THE PLATFORM, OR LOSS OF, UNAUTHORIZED ACCESS TO, OR ALTERATION OF YOUR TRANSMISSIONS OF DATA.

10. INDEMNIFICATION

You agree to indemnify, defend and hold harmless Ruqyaah.com and its parent, subsidiaries, affiliates, officers, directors, employees, suppliers, consultants and agents from any and all third party claims, liability, damages and/or costs (including, but not limited to, attorneys fees) arising from Your use of the Services, Your violation of the Agreement, or Your violation of any third party’s rights, including without limitation, infringement by You or any other user of Your account of any intellectual property or other right of any person or entity. These Terms will inure to the benefit of Ruqyaah.com’s affiliates, successors, assigns, and licensees.

11. PROPRIETARY RIGHTS TO THE CONTENT

You acknowledge that the content, including but not limited to text, software, music, sound, photographs, video, graphics or other material contained in either sponsor advertisements or distributed via email, commercially produced information presented to you by Ruqyaah.com, its suppliers, and/or advertisers, is protected by copyrights, trademarks, service marks, patents and/or other proprietary rights and laws. You are not permitted to copy, use, reproduce, distribute, perform, display, or create derivative works from the Content unless expressly authorized by Ruqyaah.com, its suppliers, or advertisers.

12. NOTICES

Except as otherwise stated in these Terms, all notices to a party shall be in writing and shall be made either via email or courier/ speed post. Notice shall be deemed given 24 hours after an email is sent, or 7 days after dispatch, to you at the address provided by you in the Registration Data and to Ruqyaah.com at the address set forth in clasue 1.5 of these Terms.

13. CHOICE OF LAW

These Terms are governed by the laws of India. The Parties hereby agree that the courts at Pune shall have exclusive jurisdiction over any dispute arising out of these Terms.

14. GENERAL PROVISIONS

If for any reason a court of competent jurisdiction finds any provision or portion of these Terms of Service or Privacy Policy to be unenforceable or invalid, such provision shall be changed and interpreted so as to best accomplish the objectives of such unenforceable or invalid provision within the limits of applicable law, and the remainder of the Terms of Service or Privacy Policy, as applicable, will continue in full force and effect. Headings are for reference purposes only and in no way define, limit, construe, or describe the scope or extent of such section. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by Ruqyaah.com. These Terms of Service constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter/ s.

15. DELIVERY, RETURN & CANCELLATION

a. Reports: While availing the Platform services, you will be required to exercise due discretion and care while ordering reports. Once the report has been allocated for processing, no refund requests will be entertained. However, if you wish to cancel an order for a report, you can do so within one hour of placing the order, in which case you will have to e-mail our customer care team at support@Ruqyaah.com.com. Reports are delivered within 72 hours from the time the required inputs are provided by the user. Please check product page for exact delivery times. The delivery time-frames displayed on the Platform are approximate, but we make every effort to strictly adhere to them. Minor delays which are considered reasonable will not be treated as a basis for refunds. Also, refund requests for incorrect data provided by customers will not be entertained under any circumstances. You are therefore requested to double-check your data before providing it to us.

b. Ask a Question: You may share question(s) of your choosing through the Platform, which will be directed towards our Rehbar. For this service, no cancellation requests shall be entertained. The response to the question will be delivered between 48 to 72 hours from the time the receipt of the request is acknowledged. The delivery time-frames displayed on the Platform are approximate, but we make every effort to strictly adhere to them. Since this is a personalized service, minor delays which are considered reasonable will not be treated as a basis for refunds. Also, refund requests for incorrect data provided by customers will not be entertained under any circumstances. You are therefore requested to double-check your data before providing it to us.

c. Talk To Rehbar  Minutes: Once you have paid for the minutes to speak to the Rehbar, refund requests will not be entertained under any circumstances. Talk to Rehbar Minutes are credited to your account instantly on submission of your input details, including your Registered Mobile Number and email ID.

General Terms and conditions for Online Dua Service for users:

1. User can book online Dua by paying a certain fees; the fees is decided by the Rehbar and Ruqyaah.com with mutual understanding and shall be displayed on the Platform.

2. User can view the live pooja (Online) being performed by the Rehbar from any location.

3. Rehbar will live stream the Dua for the user and it will be recorded on our server; the video of the user will also be recorded as he views the Dua. The consent for this will be deemed to be granted when the user joins the online Dua for which he/she has paced a request. Consent for using the phone camera will be sought by a pop up message from the user.

4. The recording of the Dua will be stored on our server for a period of 90 days, under which, user will have to place the request to us on support@Ruqyaah.com.com for obtaining the recording. Please note that after 90 days the video recording will be deleted, and will not be available.

5. During the live Dua, screen shots will also be taken by our software to ensure that Rehbar is diligent and has performed the Dua himself/herself for the duration committed before the user placed the order.

6. In addition to the above, all other terms and conditions mentioned in this document shall also apply on the user and the service availed.

7. Ruqyaah Closed Wallet - Terms and Conditions
   Please read the following terms and conditions (“T&Cs”) carefully before registering for, accessing or using the Ruqyaah Wallet (as defined below), located at www.Ruqyaah.com.com or the Ruqyaah.com mobile application or any similar platform (hereinafter referred to as Ruqyaah Platform) on any device and/or before availing any e-wallet services that may be offered by Ruqyaah (as defined below) on the Ruqyaah Platform (hereinafter, individually Ruqyaah Wallet Service and collectively, the Wallet Services).

The Ruqyaah Wallet is issued by and the Wallet Services are provided by BOOSTIFY NUTRACEUTICALS . The customers using the Ruqyaah Wallet may load amount in the wallet through their credit or debit cards, and the amounts in the Ruqyaah Wallet may be used for making payments towards transactions done by customers on the Ruqyaah Platform only. Customers shall not be permitted to make any cash withdrawals from the Ruqyaah Wallet.

By registering for or using Ruqyaah Wallet, you represent and warrant that you have the right, authority and capacity to enter into these T&Cs and to abide by all the T&Cs.

Eligibility

1. The Wallet Services are not available to persons under the age of 18 or to anyone previously suspended or removed by Ruqyaah from availing the Wallet Services or accessing the Ruqyaah Platform. By accepting the T&Cs or by otherwise using the Wallet Services on the Ruqyaah Platform, you represent that you are at least 18 years of age and have not been previously suspended or removed by Ruqyaah, or disqualified for any other reason, from availing the Wallet Services or using the Ruqyaah Platform.

2. In addition, you represent and warrant that you have the right, authority and capacity to enter into these T&Cs and to abide by all the T&Cs. Finally, you shall not impersonate any person or entity, or falsely state or otherwise misrepresent your identity, age or affiliation with any person or entity. Finally, in the event of any violation of the T&Cs, Ruqyaah reserves the right to suspend or permanently prevent you from availing Wallet Services or using the Ruqyaah Platform.

1. Definitions

1. “Customer” or “you” means a person who has registered with Ruqyaah Platform and avails the Ruqyaah Wallet, and who has accepted the T&Cs, and a person who owns, operates, or has access to an internet compatible device that supports the Ruqyaah Wallet and the Ruqyaah Platform.

2. “Ruqyaah Wallet” means the closed system pre-paid payment instrument issued by Ruqyaah.

3. “Ruqyaah Wallet Account” means the Customer Ruqyaah Wallet account classified as closed system payment instruments issued by accepting minimum customer details being Customer name, e-mail address, mobile number, which permit payment for purchase of eligible goods from Ruqyaah Platform.

4. “Enrolment Form” means the Ruqyaah Wallet enrolment form, as is required by Ruqyaah from the Customer at the time of registration for availing and/or continuation of the Ruqyaah Wallet.

5. “KYC” stands for Know Your Customer and refers to the personal identification and other information required by Ruqyaah from you before any Wallet Services can be delivered. KYC documents/ information may be required by Ruqyaah from the Customer at the time of registration and/or on a later date, for availing and/or continuation of the Ruqyaah Wallet.

6. “Password” means the secret password used to secure Ruqyaah Wallet applications, without knowledge of which your Ruqyaah Wallet will not be operable.

7. “Transaction” means purchase of eligible products/ services on the Ruqyaah Platform.

2. Documentation

1. The collection, verification, audit and maintenance of correct and updated Customer information is a continuous process and Ruqyaah reserves the right, at any time, to take steps necessary to ensure compliance with all relevant and applicable KYC requirements. Ruqyaah reserves the right to discontinue services or reject applications for Ruqyaah Wallet at any time if there are discrepancies in information and/or documentation by you.

2. You may be required to complete a verification process by furnishing your details (such as your name and date of birth) to comply with the KYC requirement under applicable laws.

3. Any information provided to Ruqyaah with the intention of securing Ruqyaah Wallet services shall vest with Ruqyaah, and may be used by Ruqyaah, for any purpose that is not inconsistent with any applicable law or regulations, at its discretion.

3. General Conditions for Ruqyaah Wallet

1. You will be issued an Ruqyaah Wallet Account immediately after successful registration.

2. You may add money to or recharge your Ruqyaah Wallet through online payment methods such as domestic credit/debit card and net banking. However, you will not be able to use prepaid/virtual bank cards, EMI, cards issued outside India or a combination of cards to add money to or recharge your Ruqyaah Wallet. Except as provided hereunder, amounts in your Ruqyaah Wallet will not be refunded to you under any circumstances.

3. You may note that withdrawing money from Ruqyaah Wallet is not allowed. Any outstanding credit in the Ruqyaah Wallet must be utilized only to make payments for bona fide Transactions.

4. Ruqyaah Wallets are available only to resident Indians who have attained the age of 18 years and are competent to contract.

5. Ruqyaah Wallets are not transferable.

6. You may add money into your Ruqyaah Wallet upto a maximum of INR 10,000/- (Rupees ten thousand) per month. This limit will be inclusive of any credits made by you and any refunds received by you for any Transactions in your Ruqyaah Wallet. Additionally, the balance in your Ruqyaah Wallet shall not exceed INR 10,000/- (Rupees ten thousand) at any relevant time of determination. These limits may be reviewed and modified at the discretion of Ruqyaah without prior intimation to the Customer.

7. Ruqyaah reserves the right to suspend/discontinue Ruqyaah Wallet services to you at any time, for any cause, including, but not limited, to the followingi. For any suspected violation of the T&Cs; ii. For any suspected discrepancy in the particular(s), documentation or Enrolment Form provided by you;

iii. To combat potential fraud, sabotage, wilful destruction, threat to national security or for any other force majeure event;

iv. If the same is due to technical failure, modification, upgradation, variation, relocation, repair, and/or maintenance due to any emergency or for any technical reasons;

v. If the same is due to any transmission deficiencies caused by topographical and geographical constraints/limitations;

vi. If the mobile connection with which your Ruqyaah Wallet is related ceases to be operational or in your possession or control;

vii. If Ruqyaah believes, in its reasonable opinion, that cessation/suspension is necessary for any other legitimate purpose.

h. The value stored on your Ruqyaah Wallet shall NOT be refunded under ANY circumstances and may only utilized to make payments for bona fide Transactions. No interest will be payable by Ruqyaah on the available balance reflected on the Ruqyaah Wallet.

i. You are permitted to maintain and operate only one Ruqyaah Wallet. Any suspected nonconformity with this requirement shall constitute grounds for the suspension/discontinuation by Ruqyaah of any of all Ruqyaah Wallets associated with you on the Ruqyaah Platform. Any operation of or continued availability of any facility respect to the Ruqyaah Wallets from time to time shall be subject to any requirements under applicable laws, and any new regulations or directions from any regulatory authorities in India.

4. Ruqyaah Wallet Validity

1. Any value in your Ruqyaah Wallet that is utilized towards making payments for any Transaction shall be automatically debited from your Ruqyaah Wallet. Ruqyaah does not endorse, promote or warrant any goods and/or services that might be bought/availed or proposed to be bought/availed using Ruqyaah Wallet.

2. Ruqyaah Wallet Expiry and Balance Forfeiture- Your Ruqyaah Wallet account shall stay active for a period of (1)one year. In the event of non-usage of the wallet, any balance in your Ruqyaah Wallet shall expire on the completion of a period 1 (one) year from the last day of activity.

5. Customer Obligations

1. Any value in your Ruqyaah Wallet that is utilized towards making payments for any Transaction shall be automatically debited from your Ruqyaah Wallet. Ruqyaah does not endorse, promote or warrant any goods and/or services that might be bought/availed or proposed to be bought/availed using Ruqyaah Wallet.

2. Ruqyaah Wallet availability is subject to the maintenance of an active mobile phone or internet connection with an associated telecom provider. Ruqyaah Wallet availability is subject to the maintenance of a mobile phone handset and other application on which Ruqyaah Platform can run and the Customer is solely responsible for all liability arising from unavailability of the Ruqyaah Platform due to a deficient mobile handset or the internet service provider not being able to support any Ruqyaah Wallet channel or application.

3. You must ensure the availability of sufficient funds in your Ruqyaah Wallet before executing any Transaction from your Ruqyaah Wallet.

4. You shall be solely responsible for the confidentiality, safety and security of the Password. You shall be the sole owner of the Password and shall be responsible for the consequences arising out of disclosure of the Password and/or the unauthorized use of Ruqyaah Wallet. In case the Password is lost or misplaced, you shall promptly inform Ruqyaah by emailing on the support email id provided; where after the existing Password will be barred and a new Password will be issued to you after necessary validation. In case the mobile phone/SIM card/mobile number associated with your Ruqyaah Wallet is lost/stolen/misplaced/no longer in your control, you shall promptly inform Ruqyaah. Ruqyaah will, upon receipt of such information, block the relevant account.

5. You acknowledge and understand that Ruqyaah Wallet is linked to your mobile phone number and you shall be solely responsible for any liability arising out of the loss/theft/misuse of the mobile phone number or deactivation of mobile connection by the concerned telecom service provider.

6. Information submitted by you for availing Ruqyaah Wallet and/or information submitted while using Ruqyaah Wallet may be shared by Ruqyaah with any affiliate of Ruqyaah or any third party, inter alia, to facilitate the provision of Ruqyaah Wallet or for the purposes specified in the T&Cs.

6. Indemnification

You agree to indemnify, save, and hold Ruqyaah, its affiliates, contractors, employees, officers, directors, agents, licensors, and partners harmless from any and all claims, losses, damages, and liabilities, costs and expenses, including without limitation legal fees and expenses, arising out of or related to : (i) your use or misuse of the Ruqyaah Wallet; (ii) any violation by you of the T&Cs, including the Ruqyaah Wallet Terms; or (iii) any breach of the representations, warranties, and covenants made by you herein. Ruqyaah reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify Ruqyaah, including rights to settle, and you agree to cooperate with Ruqyaah’s defense and settlement of these claims. Ruqyaah will use reasonable efforts to notify you of any claim, action, or proceeding brought by a third party that is subject to the foregoing indemnification upon becoming aware of it. This paragraph shall survive termination of these T&Cs, including the Ruqyaah Wallet Terms.

7. Additional T&C.

1. Any amount transferred erroneously by the Customer, while adding money to or recharging the Ruqyaah Wallet or while executing Transaction on Ruqyaah Platform, shall not be refunded to the Customer by Ruqyaah in any circumstances.

2. Any web-link on the Ruqyaah Platform to a third-party site is not an endorsement of that weblink. By using or browsing any such other web-link, you shall be subject to the terms and conditions in relation to that web-link.

3. In the event of any Dispute (defined below), Ruqyaah records shall be binding as the conclusive evidence of the Transactions carried out through the use of Ruqyaah Wallet.

4. Ruqyaah shall send all customer communications by SMS and/or e-mail and such SMS shall be deemed to have been received by you after they have been submitted for delivery to the mobile phone operator.

5. You agree to receive all commercial messages including transactional messages from Ruqyaah.

6. The parties are independent contractors and nothing in these Ruqyaah Wallet Terms shall be deemed to create an agency or employment relationship, a franchisor-franchisee relationship, joint venture or partnership.

8. Amendment of Terms, Ruqyaah Platform

Ruqyaah may modify, terminate and/or suspend Ruqyaah Wallet to the Customer anytime with or without prior notice, due to any changes in internal policies, rules, regulations and laws set by relevant authorities/regulators. Ruqyaah reserves the right to change, modify, add, or remove portions of these T&Cs (each, a change and collectively, changes) at any time by posting notification on the Ruqyaah Platform or otherwise communicating the notification to you. The changes will become effective, and shall be deemed accepted by you, 12 hours after the initial posting and shall apply immediately on a going-forward basis with respect to your use of the Ruqyaah Platform, availing the Ruqyaah Wallet service, or for payment transactions initiated after the posting date. If you do not agree with any such change, your sole and exclusive remedy is to terminate your use of the Ruqyaah Platform/Ruqyaah Wallet. For certain changes, Ruqyaah may be required under applicable law to give you advance notice, and Ruqyaah will comply with such requirements. Your continued use of the Ruqyaah Platform and the Ruqyaah Wallet following the posting of changes will mean that you accept and agree to the changes.

9. Confidentiality

You specifically agree that in order to facilitate the provision of Ruqyaah Wallet, Ruqyaah may be required to disclose any information or particulars pertaining to you to any authority, statutory or otherwise or any third party.

10. Assignment; Restrictions on Information Sharing; Privacy

1. These T&Cs, and any rights granted hereunder, may not be transferred or assigned by you without Ruqyaah’s prior written consent which may be withheld in Ruqyaah’s sole discretion, but these T&Cs, and any rights granted hereunder, may be assigned by Ruqyaah freely (including to its affiliates) and without any restriction. Any assignment attempted to be made by you in violation of this provision shall be void and of no effect.

2. By accepting the Ruqyaah Wallet Terms here and the T&Cs in general, you agree to be customers of Ruqyaah. In addition, by accepting the Ruqyaah Wallet Terms here and the T&Cs in general, you expressly and impliedly provide your free and unconditional consent for the following: (i) for transferring Ruqyaah’s rights and obligations under the Ruqyaah Wallet Terms in favour of any affiliate of Ruqyaah or any third party; (ii) for using the Ruqyaah Platform and availing the Wallet Services by you subject to any specific terms and conditions imposed by any affiliate of Ruqyaah; (iii) for receiving communications, notices and information from Ruqyaah or any affiliate of Ruqyaah; (iv) for sharing of business information (including any information relating to you or the services being availed by you) in relation to the Ruqyaah Wallet service (including data analytics) between Ruqyaah and any affiliate, insofar as such sharing of business information is necessary or required for the following limited purposes: (a) provision of better services to Ruqyaah’s customers (including you); (b) provision of better services by Ruqyaah’s vendors and Merchant Establishments; (c) to prevent any breach of a binding agreement between Ruqyaah and any affiliate, or to give effect to any such agreement; (d) for ensuring compliance with the applicable law or legally compelled disclosures by Ruqyaah or any affiliate of Ruqyaah; or (e) for preventing fraud and money laundering and for enhancement of risk mitigation systems and processes in relation to the activities of Ruqyaah or of any affiliate of Ruqyaah; or (f) Ruqyaah retaining any and all information relating to you till such time as may be required under applicable laws or internal policies. At times Ruqyaah or its affiliates may make certain personal information available to affiliates, and, strategic partners that work with Ruqyaah to provide products and services, or that help Ruqyaah market to customers. Personal information will only be shared by Ruqyaah to provide or improve Ruqyaah’s services and advertising, and will always be shared in compliance with applicable laws.

3. Ruqyaah, amongst others, shares information with companies (including with its affiliates) who provide services such as information processing, extending credit, fulfilling customer orders, delivering products and Services to you, managing and enhancing customer data, providing customer service, assessing your interest in Ruqyaah’s products and services offering any products or services from any Ruqyaah Platform, and conducting customer research or satisfaction surveys. Any such sharing will be in compliance with applicable laws and these companies are obligated to protect your personal information under applicable law.

4. It may be necessary − by law, legal process, litigation, and/or requests from public and governmental authorities − for Ruqyaah to disclose your personal information. Ruqyaah may also disclose information about you if Ruqyaah determines that for purposes of national security, law enforcement, or other issues of public importance, disclosure is necessary or appropriate.

5. Ruqyaah may also disclose information about you if Ruqyaah determines that disclosure is reasonably necessary to enforce the Ruqyaah Wallet Terms here or the T&Cs in general or protect Ruqyaah’s operations or users. Additionally, in the event of a reorganization, transfer, merger, or sale of all or any portion of Ruqyaah’s business or products or services offered through any Ruqyaah Platform to any persons (including any affiliates), Ruqyaah may transfer any and all personal information that Ruqyaah collects to the relevant transferee or enter into contractual agreements to share such information with such transferees, and transfer any contractual rights or benefits to such transferees., Ruqyaah may transfer any and all personal information that Ruqyaah collects to the relevant transferee or enter into contractual agreements to share such information with such third party transferee.

6. Ruqyaah’s privacy policy applies to use of the Ruqyaah Platform, and its terms are made a part of these T&Cs by this reference. Additionally, by using the Ruqyaah Platform, you acknowledge and agree that internet transmissions are never completely private or secure. You understand that any message or information you send to the Ruqyaah Platform may be read or intercepted by others, even if there is a special notice that a particular transmission (for example, credit card information) is encrypted.

11. Intellectual Property Rights

Ruqyaah, or its licensors, own all right, title and interest, including, but not limited to all copyright, trademark, patent, trade secret or other proprietary rights (hereinafter IP Rights), in and to the Ruqyaah Platform, Wallet Services, Ruqyaah Wallet or usage data. You shall not reproduce, distribute, transmit, modify, create derivative works, display, perform or otherwise use the Ruqyaah Platform, Wallet Services or Ruqyaah Wallet or any of the IP Rights, or attempt to reverse engineer, decompile, disassemble, or derive the source code for the Ruqyaah Platform or Ruqyaah Wallet or use the Ruqyaah Platform or Ruqyaah Wallet to create a competing product. Unauthorized use of “Ruqyaah” as a word, trademark, symbol, device mark or word mark, is strictly prohibited. All rights are expressly reserved by Ruqyaah to use the brand of “Ruqyaah” in all its forms and variations.

12. Disclaimer; No Warranties

1. Ruqyaah gives no warranty, express or implied, with respect to the BB Platform and Ruqyaah Wallet. To the fullest extent permissible, pursuant to applicable law, Ruqyaah and its third-party partners, licensors and suppliers disclaim all warranties or guarantees - whether statutory, express or implied - including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights. Ruqyaah provides the Ruqyaah Platform and the Ruqyaah Wallet and any other technology and services on the Ruqyaah Platform are on an “as is”, “where is”, “with all faults” basis.

2. No advice or information, whether oral or written, obtained by you from Ruqyaah or through the Ruqyaah Wallet or the Ruqyaah Platform will create any warranty or guarantee other than those expressly stated herein. For the purposes of this Disclaimer, you expressly acknowledge that as used in this section, the term “Ruqyaah” includes Ruqyaah’s officers, directors, employees, shareholders, agents, licensors, subcontractors and affiliates. You expressly agree that use of the Ruqyaah Wallet on the Ruqyaah Platform is at your sole risk. It is your responsibility to evaluate the accuracy, completeness and usefulness of all opinions, advice, services, merchandise and other information provided through the Ruqyaah Platform or on the Internet generally.

3. The Ruqyaah Wallet and the Ruqyaah Platform and any data, information, third party software, reference sites, services, or software made available in conjunction with or through the services and the site are provided on an “as is” and “as available,” “with all faults” basis and without warranties or representations of any kind either express or implied. Ruqyaah, , licensors, and partners do not warrant that the data, Ruqyaah software, functions, or any other information offered on or through the Wallet Services/Ruqyaah Platform or any reference sites/platforms/apps/services will be uninterrupted, or free of errors, viruses or other harmful components and do not warrant that any of the foregoing will be corrected.

4. Ruqyaah and its licensors, and partners do not warrant or make any representations regarding the use or the results of the use of the Wallet Services/Ruqyaah Platform or any reference sites/platforms/apps/services in terms of correctness, accuracy, reliability, or otherwise. You understand and agree that you use, access, download, or otherwise obtain information, materials, or data through the Wallet Services/Ruqyaah Platform or any reference sites/platforms/apps/services at your own discretion and risk and that you will be solely responsible for any damage to your property (including your computer system and mobile device or any other equipment) or loss of data that results from the download or use of such material or data. We do not authorize anyone to make any warranty on our behalf and you should not rely on any such statement.
   This section shall survive termination of the T&Cs. In no event will Ruqyaah be liable for any incidental, consequential, or indirect damages (including, but not limited to, damages for loss of profits, business interruption, loss of programs or information, and the like) arising out of the use of or inability to use the Ruqyaah Platform.

13. Waiver and Release

The failure of Ruqyaah to exercise or enforce any right or provision of the T&Cs will not constitute a waiver of such right or provision. Any waiver of any provision of the T&Cs will be effective only if in writing and signed by Ruqyaah. To the maximum extent permitted by law, you waive, release, discharge and hold harmless Ruqyaah, its affiliates, and each of their directors, officers, employees, and agents, from any and all claims, losses, damages, liabilities, expenses and causes of action arising out of your use of the Ruqyaah Platform or Ruqyaah Wallet.

14. Consent to Electronic Communications and Transactions

By registering to use the Ruqyaah Wallet, you consent to conduct Transactions and receive communications, notices and information from us electronically, whether sent by e-mail or other electronic means. Electronic communications shall be deemed to have been received by you when Ruqyaah sends an electronic communication to your e-mail address/mobile number as per our records, or when Ruqyaah posts an electronic communication on the Ruqyaah Platform. The pre-requisites for effective electronic Transactions and communications are as follows: (i) you must have access to the Internet through a broadband connection or mobile data or through any other applications; and (ii) you must have a valid e-mail address and mobile number. You can withdraw your consent for electronic communication at any time by contacting Ruqyaah, but Ruqyaah reserves the right to terminate your Ruqyaah Wallet Account, as the case may be, upon such withdrawal. Withdrawal of your consent for electronic communication will not affect the legal validity and enforceability of any notice, statement or disclosure previously received electronically. You agree to notify Ruqyaah promptly if your email address, mobile number or other contact information changes by updating your account information or contacting Ruqyaah.

15. Limitation of Liability

1. In no event, Ruqyaah or its contractors, agents, licensors, partners or suppliers will be liable to you for any special, indirect, incidental, consequential, punitive, reliance, or exemplary damages (including without limitation lost business opportunities, lost revenues, or loss of anticipated profits or any other pecuniary or non-pecuniary loss or damage of any nature whatsoever) arising out of or relating to: (i) these T&Cs; (ii) the Ruqyaah Wallet, the Ruqyaah Platform or any reference site/app/platform/service; or (iii) your use or inability to use the Ruqyaah Wallet, the Ruqyaah Platform (including any and all materials) or any reference sites/app/platform/service or (iv) any other interactions with Ruqyaah, however caused and whether arising in contract, tort including negligence, warranty or otherwise, even if Ruqyaah or a Ruqyaah authorized representative has been advised of the possibility of such damages.

2. You acknowledge and agree that Ruqyaah has offered its products and services, set its prices, and entered into these T&Cs in reliance upon the warranty disclaimers and the limitations of liability set forth herein, that the warranty disclaimers and the limitations of liability set forth herein reflect a reasonable and fair allocation of risk between you and Ruqyaah, and that the warranty disclaimers and the limitations of liability set forth herein form an essential basis of the bargain between you and Ruqyaah. Ruqyaah would not be able to provide the services to you on an economically reasonable basis without these limitations. Applicable law may not completely allow the limitation or exclusion of liability or incidental or consequential damages, so the above limitations or exclusions will apply to you subject to applicable law. In such cases, Ruqyaah’s liability will be limited to the fullest extent permitted by applicable law. This section of the Ruqyaah Wallet Terms shall survive the termination of these T&Cs.

16. Dispute Resolution

If any dispute, controversy or claim arises under these T&Cs or in relation to a Ruqyaah Wallet or the Ruqyaah Platform, including any question regarding the existence, validity or termination of the Ruqyaah Wallet Terms or the T&Cs in general or these T&Cs (hereinafter Dispute), the parties shall use all reasonable endeavours to resolve such Dispute amicably. This paragraph shall survive termination of these T&Cs.

17. Governing Law

Subject to the foregoing clause 16, you agree that any claim or dispute arising herefrom shall be subject to the exclusive jurisdiction of courts at New Delhi, India. These T&Cs shall be governed by Indian law. This paragraph shall survive termination of these T&Cs.

18. Severability

If any provision of the T&Cs in general or as a whole is held to be unlawful, void, invalid or otherwise unenforceable, then that provision will be limited or eliminated from the T&Csto the minimum extent required, and the remaining provisions will remain valid and enforceable.

19. Customer Service

Any questions, comments or complaints related to your Ruqyaah Wallet should be referred to Ruqyaah customer care by email to info@Ruqyaah.com In compliance with Rule 11(2)(a) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, 

Before making a Grievance, complainants are encouraged to go through the above-mentioned Rules along with the self-regulating mechanism provided therein.
